Your Circle is a NDIS provider delivering supports and services to eligible participants in accordance with the National Disability Insurance Scheme (NDIS) Act 2013, related legislation, and the NDIS Practice Standards.

2.1 You may use our Website for lawful purposes only. You agree not to:

  • Access any unauthorized areas of this Website;
  • Attempt to harvest data or use bots, scrapers, or any automated systems that interfere with the Website operation;
  • Upload or transmit any malicious software or viruses.
  • Engage in any activity that could damage, disable, overburden, or impair the Website.
  • Use the Website to harass, abuse, defame, or otherwise infringe upon the rights of others.

3. Services and Eligibility

3.1

Services are provided consistent with an individual's approved NDIS plan and within the scope of Your Circle's registration and capability.

3.2

Your Circle reserves the right to refuse or suspend services if eligibility criteria are not met, if there are compliance issues, or if risks are identified that may affect safe service delivery.

3.3

Participants are responsible for informing Your Circle promptly of any changes to their NDIS eligibility, funding status, or plan that may affect service delivery.

4. Service Agreements

4.1

Before commencing supports, a Service Agreement will be provided outlining the detailed services, fees, payment terms, cancellation policy, responsibilities, and other key terms.

4.2

Service Agreements must be signed by all parties before supports commence.

4.3

Service Agreements will include, but are not limited to:

  • Provider contact and registration details
  • Description of supports and delivery methods
  • Pricing compliant with the current NDIS Price Guide
  • Cancellation, no-show, and refund policies
  • Roles and responsibilities of participants and provider
  • Conflict of Interest disclosures
  • Participant consent for data use and sharing in accordance with privacy laws

5. Fees and Payment

5.1

Fees are charged in accordance with the NDIS Price Guide and the participant's funding arrangements (Plan-managed, Self-managed, or Hybrid).

5.2

Participants will be informed of all costs upfront, and invoices will clearly list services provided.

5.3

Payments must be made promptly as per the Service Agreement.

5.4

If payments are late, Your Circle reserves the right to suspend services until outstanding amounts are paid. Continued non-payment may lead to referral to debt collection agencies, in strict accordance with Australian Consumer Law and relevant NDIS rules.

6. Participant / Participant's Representative Responsibilities

6.1 Participants agree to:

  • Provide accurate and updated information to Your Circle;
  • Notify Your Circle immediately of any changes to their NDIS plan, funding, eligibility, or personal circumstances affecting service delivery;
  • Participate actively in service planning and feedback;
  • Ensure a safe and hazard-free environment for Your Circle's staff when supports are delivered, consistent with Work Health and Safety legislation to facilitate safe and effective service delivery.

7. Privacy and Confidentiality

7.1

Your Circle handles personal and sensitive information as described in our Privacy Policy.

7.2

Please refer to the full Privacy Policy available on our website at yourcircle.com.au/privacypolicy for detailed information about how we collect, use, store, and protect your information including our use of cookies and tracking technologies.

8. Quality and Compliance

8.1

Your Circle complies with the NDIS Code of Conduct and Practice Standards to provide safe, respectful, and high-quality supports.

8.2

We maintain detailed records of supports delivered in accordance with NDIS audit requirements.

8.3

We undertake regular staff training, and continuous improvement activities to ensure ongoing compliance and quality service delivery.

9. Third-Party Services Disclaimer

Our Website and some service delivery functions rely on trusted third-party service providers, such as those providing website hosting, CRM systems, email delivery, and secure cloud storage.

While we take reasonable measures to ensure these providers meet privacy and security standards, we are not responsible for any disruption, data loss, or issues arising from their systems or networks. Where providers store or process data overseas, they are required to protect your information in accordance with Australian privacy laws.

12. Disclaimers and Limitations of Liability

12.1

To the maximum extent permitted by law, Your Circle excludes all warranties, express or implied, including regarding accuracy, completeness, or fitness for a particular purpose of Website content or Services.

These Terms are governed by the laws of the Australian Capital Territory.

16.2

Any disputes arising will be resolved in the ACT courts. Users from other states or countries agree to submit to the exclusive jurisdiction of ACT courts.

17. Changes to Terms

17.1

Your Circle may update these Terms occasionally. Updated versions will be posted on the Website at least 7 days before taking effect.

17.2

Continued use of the Website or Services after changes constitutes acceptance of the updated Terms.
